Proposal to Modify the RVAHJ Constitution

Introduction

Over the past few years, the Royal Victorian Association of Honorary Justices (RVAHJ) has been working towards registration as a charity with Deductable Gift Recipient (DGR) status.

This would allow us to apply for a much wider range of grants and to philanthropic trusts for funding.

We have worked with a firm of solicitors who specialise in charities and taxation law and we have achieved charity status but were refused the DGR status as the taxation criteria was not able to be achieved with our current constitution.

This constitution does not allow us to be recognised as a benevolent institution as it was seen to only address the needs of our members, not those in need in the community.

Further advice from a Queen’s Counsel at the time referred us to the constitution proforma produced by the Australian Charities and Not-for profit Commission (ACNC) and a new constitution has been developed using that proforma, only inserting the sections required to be filled out to reflect our core business and operation.

This has now been reviewed by the King’s Counsel (title change due to the change in monarchy) and the indication is that it may assist us achieve our goal of DGR as it shows that we operate in a benevolent way in society. Operational parts of the old constitution which are not able to be included in the proposed constitution will be redeveloped as bylaws.

As a reminder, the ‘ANNUAL GENERAL MEETING TO CONSIDER THE CHANGES’ are as follows:
The Annual General Meeting of Royal Victorian Association of Honorary Justices will be held on Thursday, 16th May 2024 at 7.30 pm AEST at 53 Broadway, Elwood, and online using Zoom, to consider the proposed constitution.
